   JOINING THE CLASS ACTION LAWSUIT

 

Several Battelle employees have filed a class action lawsuit against Battelle to recover unpaid wages and overtime.  Any employee who works or worked as a Monitoring or Laboratory Technician for Battelle at the TOCDF from June 19, 2004 may join in the class action by filing the signed consent form

 

Employees who want to share in any recovery of any unpaid wages must join the FLSA action by sending a completed Consent to Join Form (as described in more detail below) to the Class Counsel. 

 

Battelle employees who do not join in the FLSA claims will not be allowed to share in the recovery of any federal overtime wages.

 

If you are interested in joining the FLSA class action so that you can share in any recovery of FLSA overtime wages, you must send in a  completed, signed "Consent to Join" form.  To do so, please follow these steps:

Step One

  1. Get the Consent to Join form (Click here for PDF format, or Click here for MS Word format)

  2. Print out the Consent to Join form.

  3. Complete the Consent form.  Remember to sign and date at the bottom.

Step Two

  1. Mail the completed, signed Consent to Join form to the following address:

Join Promptly -- Delay Could Reduce Any Recovery

 

In an FLSA action, a successful claimant (i.e., a plaintiff) may be able to recover for overtime compensation for a limited period before his or her Consent to Join form is filed with the Court.  Consequently, each day of delay may result in a corresponding loss of one day's overtime that may be recovered.  Therefore, if you decide to join this suit, you should return the Consent Form without delay.
