How to Join the Collective (Class) Action
A class action lawsuit has been
filed in the Federal Court by Battelle employees on behalf of other former
and current employees. Any employee who worked for Battelle in the Utah at any time
in the last four years may join in the class action by notifying the
sending the signed consent form to the class counsel.
Employees who want
to share in any recovery of any unpaid wages
must join the
FLSA action by sending a completed Consent to Join form to the Court
(as described in more detail below).
Battelle employees who do not join in the FLSA
claims will not be allowed to share in the recovery of any federal
overtime wages.
If you are interested in joining the FLSA class
action so that you can share in any recovery of FLSA overtime wages,
you must send in a completed, signed "Consent
to Join" form. To do so, please follow these steps:
Step One

Get the
Consent to Join

Print out the Consent to Join form.

Complete the Consent form.
Remember to sign and date at the bottom.

Mail the completed, signed Consent to Join

Join Promptly -- Delay Could
Reduce Any Recovery
In an FLSA action,
a successful claimant (i.e., a plaintiff) may be able to recover for
overtime compensation for a limited period before his or her Consent to
Join form is filed with the Court. Consequently,
each day of delay may result in a corresponding loss of one day's
overtime that may be recovered. Therefore, if you
decide to join this suit, you should return the
Consent to Join form without delay.
