About the FLSA Overtime Wage Claims
Battelle's employees Mr.
Jason Sweat and Ms. Sue Renzello
individually and on behalf of others
similarly situated current and former employees
have filed a collective (class) action lawsuit
against Battelle in the
United States District Court for the District of Utah, Salt Lake City,
Utah.
The federal overtime law is known as
the
Fair Labor Standards Act, or FLSA for short. Under FLSA,
employees are entitled to time and one half overtime pay for every hour
worked after 40 hours in a week. The statute of limitations is
two years unless the employer can be shown to have willfully violated
FLSA. In that case, the plaintiffs can also receive liquidated
damages. In this case, we are seeking liquidated damages under FLSA, which would double the amount of overtime
owed.
We will soon file the motion with
the court to certify the FLSA overtime
claims as class action. In order
to share in any FLSA overtime recovery or settlement, former and
current employee must
join the
FLSA collective action.
